10 years IHL for attempted rape in Kasungu

First Grade Magistrate Court sitting at Santhe in Kasungu on Wednesday convicted and sentenced a 26-year-old man, Geoffrey Kwenda, to 10 years imprisonment with hard labour for attempting to rape a 17-year-old girl.

The court, through Police Prosecutor Sub Inspector Ulemu Botha, heard that on September 5, 2021 around 9 o’clock in the morning, the victim went to a nearby river to wash clothes and kitchen utensils.

While there, the suspect came asking for a cup to drink water before starting to advance on the girl.

The court further learnt that the victim, upon sensing some danger, started running away but the offender chased her until he caught her before trying to force himself on her.

The victim screamed for help, prompting people to come to her rescue.

Kachikho: the convict was apprehended by the communities

According to Kasungu Police Public Relations Officer, Joseph Kachikho, the suspect was immediately apprehended and handed over to the police. 

Appearing before court, the offender pleaded not guilty to the charge of attempted rape, which prompted the state to parade three witnesses to prove the case.

In his submission, the police prosecutor prayed for a custodial sentence for the accused, saying such cases are on the increase in Kasungu as well as the whole country and also that such behaviour causes trauma to the victims.

In his mitigation, Kwenda appealed to the court for forgiveness, saying he has a big family obligation and that he was also taking care of her sick grandmother.

However, passing sentence, First Grade Magistrate Jones Masula concurred with the police prosecutor and sentenced Kwenda to a 10-year jail term to deter other would-be offenders from committing a similar offence.

Kwenda comes from Nyemba Village in Traditional Authority Chidzuma in Kasungu District.
