28 years IHL for defiling stepdaughter

The Senior Resident Magistrate’s (SRM) Court in Lilongwe has on October 27, 2021 slapped a 31 year old man, Paul Jentala, with a 28-year jail term for defiling a 9 year old step daughter.

The court heard through state prosecutor, Sub Inspector Humphreys Makhaliha of Kawale Police that Jentala got married in 2018 to a businesswoman with two children, a boy and a girl, from another man.

The court was further told that due to the nature of her business the woman left her children under the watch of their stepfather.

The man took advantage of this and started sleeping with the girl in the month of January 2019.

The court was told that on February 22, 2019 the wife went to her usual business leaving the two children in the hands of the husband and during the night the man went to the bedroom to quench his libido.

Being tired of this, the girl rejected his advances and escaped to her uncle where she revealed everything.

The matter was reported to Kawale Police where investigations were conducted that led to his arrest.

Appearing in court, Jentala pleaded not guilty to the charge which prompted the state to parade four witnesses who proved the case beyond a reasonable doubt.

In his submission, Makhaliha moved the court to exercise Section 14 (6) for a stiffer punishment, citing that such cases are on the rise in the area.

In mitigation, Jentala prayed for leniency, claiming that he didn’t defile the child since he was impotent after he was involved in a road accident.

Passing the sentence, Magistrate Florence Msekandiana quashed the mitigation and instead concurred with the state and ordered the convict to serve a 28-year jail term.

Jentala hails from kadzambe Village, Traditional Authority Malili in Lilongwe District.
