Breaking into building lands man 30 months jail term in Dowa

The Dowa First Grade Magistrate’s Court on Monday convicted and sentenced a 24-year-old man to 30 months imprisonment with hard labour for the offence of breaking into a building and committing a felony therein contrary to Section 312 of the Penal Code.

State prosecutor Sub Inspector Ezara Bakili told the court the convict, Tsogolani Nyanda, during the night of May 31 2021 at Dowa Market in Dowa District broke and entered a shop belonging to Chimwemwe Konzekani with intent to steal.

Appearing before the court, the convict pleaded not guilty to a charge of breaking into a building and committing a felony therein.

However, this prompted the state to parade three witnesses, who proved the case beyond a reasonable doubt, leading to his conviction.

Presiding over the case, First Grade Magistrate Amran Phiri concurred with the state’s submission for a stiff punishment hence sentenced the convict to 30 months imprisonment with hard labour, saying the sentence will deter others from committing a similar offence.

Tsogolani Nyanda comes from Nyundo Village in the area of Traditional Authority Msakambewa in Dowa District.
