Mangochi court jails rapist to 21yrs IHL

Mangochi Senior Resident Magistrate’s Court has convicted and sentenced Majid Samson, 49, to 21 years imprisonment with hard labour (IHL) for raping a 29-year-old woman.

The court heard through prosecutor, Inspector Amos Mwase that on the evening of March 5, 2022 the victim who stays at Maldeco Trading Centre was escorting her fiancé who visited her and after walking a distance, the couple noticed that they were being stalked by the convict who had two empty beer bottles in his hands.

The convict smashed the bottles and targeted the victim’s fiancé who fled and left the lady behind, Mwase told the court.

“The convict dragged the victim into a nearby maize field while pulling her hair and raped her twice,” he said.

“As if that was not enough, the convict took the victim to his house through unchartered routes where he raped her again while threatening to assault and kill her using the broken glass bottle,” he added.

Mwase said Samson dumped the victim on along the road and passers-by took her to her father’s house where she narrated the ordeal.

The victim reported the matter at Koche Police Unit where she was issued with a referral letter to Koche Community Hospital for medical examination and the results from the health facility confirmed that she was indeed raped.

Samson pleaded not guilty to the charges prompting the state to parade four witnesses who testified against him.

In mitigation, Samson asked for court’s leniency on the basis that he is a bread-winner to his family.

In his submission, Mwase said the victim was traumatized due to the torture and also her life has been affected; hence, the need for stiffer and custodial sentence.

In his ruling, Magistrate Rodrick Michongwe concurred with the state as such handed the convict a custodial sentence to act as a lesson to other would-be offenders.

Samson hails from Chipala Village in Traditional Authority Mponda’s area in Mangochi.
